Whereas, the employer desires to engage the services of an individual for employment in Hong Kong; and
Whereas, it is essential to establish the legal authorization of the individual to work in Hong Kong as required by the laws of the region;
Now, therefore, in consideration of the mutual covenants and agreements contained herein, the parties agree as follows:

The individual, hereinafter referred to as the “Employee”, hereby represents and warrants that he/she is fully authorized to work in Hong Kong in compliance with the laws and regulations governing employment in the region.

The Employer, hereinafter referred to as the “Company”, acknowledges the importance of ensuring the legal authorization of the Employee to work in Hong Kong and agrees to undertake all necessary due diligence to verify the same.

The Company shall procure all relevant documentation and permits required to validate the authorization of the Employee to work in Hong Kong and shall notify the Employee of any deficiencies or discrepancies that may impact his/her eligibility for employment in the region.

In the event that the Employee is found to be unauthorized to work in Hong Kong, the Company shall be entitled to terminate the employment contract with immediate effect without any liability or obligation for severance or compensation.

This contract shall be governed by the laws of Hong Kong and any disputes arising out of or in connection with this contract shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
